Welcome to the website of MYINDSET (“MyINDset,” “we,” “our,” or “us”). MYINDSET is a psychiatric and behavioral health practice providing medication management, individual therapy, perinatal and postpartum mental health care, peer recovery services, and related services at our offices in Brownsburg, Delphi, and Indianapolis, Indiana, as well as through telehealth throughout the state of Indiana.

These Terms and Conditions (“Terms”) govern your access to and use of our website located at www.myindset.com (the “Site”), including all content, features, and functionality available through the Site. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

2. Website Content Is Not Medical Advice

The information provided on this Site is intended for general informational and educational purposes only. Nothing on the Site is intended to be, nor should it be construed as, medical advice, psychiatric advice, a diagnosis, or a recommendation for any specific treatment or course of action.

The content on this Site does not establish a provider-patient relationship between you and MYINDSET or any of our providers. A provider-patient relationship is established only through a formal intake process, completion of required paperwork, and an in-person or telehealth evaluation with one of our licensed providers.

You should not rely on the information contained on this Site as a substitute for professional medical or psychiatric advice, diagnosis, or treatment. Always seek the advice of your physician, psychiatrist, psychiatric nurse practitioner, therapist, or other qualified health provider with any questions you may have regarding a medical or mental health condition. MYINDSET does not provide crisis services through this website.

3. Eligibility

You must be at least 18 years of age to use this Site independently. If you are a parent or legal guardian, you may access this Site on behalf of a minor child who is a patient or prospective patient of MYINDSET. By using the Site, you represent and warrant that you are at least 18 years old or that you are using the Site under the supervision of a parent or legal guardian.

Our clinical services are available to adolescents ages 13 and older and adults. If you are seeking care for a minor under the age of 18, a parent or legal guardian must be involved in the intake and consent process as required by Indiana law.

4. Description of Services

The Site provides general information about the services offered by MYINDSET, including but not limited to psychiatric medication management, individual therapy, perinatal and postpartum mental health care, lactation support, peer recovery services, and Spravato (esketamine) treatment for treatment-resistant depression.

While we strive to keep the information on this Site accurate and up to date, the services described are subject to change at any time without notice. The availability of specific services, providers, appointment times, and office locations may vary. We do not guarantee that all services described on the Site are available at all times or at all locations.

Information regarding insurance acceptance is provided as a general guide. Insurance networks, coverage, and reimbursement policies change frequently. You are responsible for verifying your specific coverage and benefits with your insurance company before scheduling an appointment. MYINDSET does not guarantee that any particular service will be covered by your insurance plan.

5. Patient Portal, Online Scheduling, and Electronic Communications

The Site may contain links to third-party platforms, including our electronic health records patient portal (currently powered by Valant) and online scheduling tools. Your use of these third-party platforms is subject to their own terms of service and privacy policies, which are separate from these Terms.

When you submit information through any intake form, contact form, scheduling tool, or other online form on or linked from the Site, you acknowledge that electronic communications are not guaranteed to be secure and that there are inherent risks in transmitting personal and health information electronically. While we use reasonable measures to protect your information, we cannot guarantee the security or confidentiality of information transmitted through the Internet.

Communications sent through this Site, including contact forms and email, are not monitored on a 24/7 basis and should not be used for urgent or emergency communications. If you need immediate assistance, please call our office at (317) 207-0273 during business hours or contact emergency services.

6. Privacy, HIPAA, and Protected Health Information

MYINDSET is committed to protecting the privacy and security of your personal information and protected health information (“PHI”) in accordance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), the HITECH Act, and applicable Indiana state privacy laws.

Our Notice of Privacy Practices, available separately on our Site and provided to all patients at intake, describes in detail how we collect, use, disclose, and safeguard your PHI in connection with your clinical care. These Terms do not replace or modify our Notice of Privacy Practices.

Information you submit through the general website (such as your name and email on a contact form) may not be protected under HIPAA until a provider-patient relationship is established. We nonetheless treat all information submitted through the Site with care and in accordance with our Privacy Policy.

We do not sell, rent, or trade your personal information or PHI to third parties for marketing purposes.

7. Intellectual Property and Content Ownership

All content on this Site, including but not limited to text, graphics, logos, images, photographs, page layouts, and the overall design and arrangement of the Site, is the property of MYINDSET Behavioral Health or its content providers and is protected by United States copyright, trademark, and other intellectual property laws.

We appreciate patient feedback and encourage honest reviews. However, please be aware that when you post a review about our practice on any public platform (such as Google, Yelp, or social media), you may be voluntarily disclosing information about your status as a patient and your health care experience. MYINDSET cannot control this disclosure, and once information is made public by you, it may no longer be protected under HIPAA.

Due to HIPAA regulations and our ethical obligations, MYINDSET is unable to respond to online reviews with any information that would confirm or deny a reviewer’s status as a patient, disclose any details about a patient’s care, or discuss any clinical matters publicly. If you have a concern about your care, we encourage you to contact our office directly so we can address it privately and promptly.​​

Nothing in these Terms is intended to limit your rights as a patient under Indiana or federal law, including but not limited to your rights under HIPAA, the No Surprises Act, or Indiana medical malpractice statutes.

13. Indemnification

You agree to indemnify, defend, and hold harmless MYINDSET, its owners, officers, employees, providers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your use of the Site, your submission of any content or information through the Site, or your violation of any applicable law or the rights of any third party.

14. Telehealth Services

MYINDSET offers telehealth services to patients located within the state of Indiana at the time of their appointment. Telehealth services are subject to the same professional standards of care as in-person services. However, telehealth has inherent limitations, including the inability to perform a physical examination and potential technology-related disruptions.

Information about telehealth on this Site is provided for general informational purposes. Separate informed consent for telehealth services is required before any telehealth appointment and will be provided during the intake process. The availability of telehealth services may change based on state regulations, insurance reimbursement policies, and clinical appropriateness

 

15. Appointment Scheduling and Cancellation Policy

Appointment scheduling is subject to provider availability. MYINDSET offers same-day appointments for medication management based on nurse practitioner availability, but we do not guarantee same-day access.

Our cancellation and no-show policies are communicated to patients during the intake process and are outlined in our practice policies, which are available separately on the Site and provided at the time of enrollment. Missed appointments or late cancellations may result in fees as described in those policies. By scheduling an appointment, you agree to comply with the cancellation and attendance policies in effect at the time of your appointment.

16. Payment, Insurance, and Financial Responsibility

You are responsible for all charges related to services rendered by MYINDSET, including but not limited to copayments, coinsurance, deductibles, and any services not covered by your insurance plan. Insurance coverage information provided on this Site is for general reference only and is not a guarantee of coverage or reimbursement.

In accordance with the No Surprises Act, you have the right to receive a Good Faith Estimate explaining how much your medical care will cost before receiving services. This estimate is available upon request and, for uninsured or self-pay patients, will be provided prior to your scheduled appointment. 17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Hendricks County, Indiana, and you consent to the personal jurisdiction of such courts.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision.

The failure of MYINDSET to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and the failure of MYINDSET to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Entire Agreement

These Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and MYINDSET with respect to your use of the Site. These Terms do not alter, amend, or replace any agreements you may have with MYINDSET relating to the provision of clinical services, including but not limited to informed consent forms, financial agreements, telehealth consent forms, or other clinical documentation.
